1. Acceptance of Terms

By accessing or using BrokerIQ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

BrokerIQ provides an AI-powered workspace for Australian mortgage brokers. The Service includes scenario management, calculators, lender product matching, client intake, lead generation, email integration, and related tools for informational and workflow purposes.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorised access to your account.
  • You must be at least 18 years old to create an account.

4. Subscriptions and Payments

Paid plans are billed monthly through Stripe. You may cancel your subscription at any time. Refunds are handled in accordance with Australian Consumer Law. Free trial access is provided on a best-effort basis and may be adjusted at our discretion.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal usage.
  • Share your account credentials with third parties.
  • Use automated systems to access the Service without our written consent.
  • Misrepresent AI-generated insights as professional financial or legal advice.

6. AI Features

The Service includes features powered by artificial intelligence and large language models. AI-generated outputs — including scenario insights, structuring recommendations, risk flags, and chat responses — are provided for informational purposes only. They do not constitute financial advice, credit advice, or any form of professional recommendation. You are solely responsible for verifying all AI-generated content before acting on it or sharing it with clients.

7. Consumer Data Right (CDR) Data

The Service displays mortgage product data sourced from CDR APIs. This data represents published product information and is indicative only. Rates, fees, and eligibility criteria may change without notice. We are not liable for decisions made based on CDR data displayed in the Service. Always confirm product details directly with the relevant lender.

8. Email Integration

The Service offers Gmail and Outlook integration via OAuth 2.0. OAuth tokens are encrypted at rest using AES-256-GCM. We do not store your email password. Email integration is used for sending client communications (e.g. intake invitations, reminders) — we do not access email content beyond what is required for the features you use. You can disconnect your email account at any time.

9. Consent & Signatures

The Service facilitates digital consent requests and signature collection. The Platform provides the mechanism for collecting signatures — the legal validity, enforceability, and appropriateness of consent obtained is your responsibility. You must ensure that your use of digital consent and signature features complies with applicable laws and your professional obligations.

10. Lead Generation

The Service provides lead generation tools including branded calculators and suburb market reports. If you use these features to collect personal information from prospective clients, your organisation is responsible for compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles in respect of that data. You must maintain your own privacy policy that covers the collection and use of lead data.

11. Third-Party Integrations

The Service may integrate with third-party services such as Google Gmail, Microsoft Outlook, and Stripe. Your use of these integrations is subject to the respective third-party terms and privacy policies. You can disconnect third-party integrations at any time from your account settings.

12. Disclaimer

The Service provides tools, data, and AI-generated insights for informational purposes only. This is not financial advice, credit advice, legal advice, or a substitute for professional consultation. 13. Limitation of Liability

To the maximum extent permitted by Australian law, Domato AI Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to:

  • Decisions made in reliance on AI-generated content, calculator outputs, or CDR data.
  • Inaccuracies in third-party data or lender product information.
  • Loss of revenue, clients, or business opportunities.
  • Failures in email delivery, consent collection, or signature processing.

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

14. Intellectual Property

All content, features, and functionality of the Service are owned by Domato AI Pty Ltd and are protected by Australian and international copyright and intellectual property laws. You retain ownership of data you input into the Service.

15. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms. Upon termination, your right to use the Service ceases immediately.

16. Governing Law

These terms are governed by the laws of the State of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

17. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms.
